Terms of Service

These Terms explain how SunnyDaysApp may be used, including outdoor planning, map features, Pathfinder routing, weather information, accounts, ads, future paid features and app availability.

Important outdoor safety notice

SunnyDaysApp is a planning and discovery app. It is not an emergency tool, rescue service, professional navigation device, avalanche warning service, official weather authority, official trail authority, ski resort authority or water-safety service.

You must not rely on SunnyDaysApp as your only source for weather, routes, terrain, avalanche risk, water safety, ski conditions, access rights, road closures, trail closures or emergency decisions. Always check real-world conditions and official local information before starting an outdoor activity.

If SunnyDaysApp is later operated by a registered company, these Terms and the Imprint will be updated with the company name, registered address and required legal details.

2. What SunnyDaysApp is

SunnyDaysApp is a mobile outdoor planning app created as a solo engineering product. It combines open-source and licensed data, modern map technology, weather layers, route calculation and local app features to help people plan sunny outdoor days.

The app is designed to help users discover places such as lakes, peaks, ski resorts, routes and sunny destinations. It can help with hiking, route planning, map previews, local favorites and outdoor decision-making.

At launch, SunnyDaysApp is intended mainly for Austria, Germany and Switzerland. More countries may be added later as additional tiles, data sources and map coverage become available.

3. Acceptance of these Terms

By downloading, accessing or using SunnyDaysApp, you agree to these Terms. If you do not agree with these Terms, do not use the app or website.

Additional terms may apply through Apple App Store, Google Play, Google AdMob, Google login, Apple login or other third-party services used by SunnyDaysApp.

4. App license

SunnyDaysApp grants you a personal, limited, revocable, non-exclusive and non-transferable license to use the app for your own normal use, subject to these Terms and applicable law.

You do not receive ownership of the app, source code, design, brand, route engine, compiled data, tile system, server infrastructure or other SunnyDaysApp intellectual property.

5. User responsibility

You are responsible for your own outdoor decisions and for your own safety. You must use common sense and check real-world conditions before going outside.

  • You must follow the laws and rules of the country, region and local area where you use the app.
  • You must respect private property, access restrictions, trail closures, road closures and local signs.
  • You must check official weather warnings, mountain warnings, ski resort information and safety notices separately.
  • You must choose routes and destinations that match your skill, equipment, health and experience.
  • You must not use the app as your only source for safety-critical decisions.

6. Weather, sun and map accuracy

Weather forecasts, sun estimates, cloud layers, temperature data, map tiles, terrain data, elevation data, outdoor categories and place information may be incomplete, delayed, unavailable or inaccurate.

Weather and outdoor conditions can change quickly. SunnyDaysApp does not guarantee that a place will actually be sunny, safe, accessible or suitable at the time you go there.

7. Routes, Pathfinder and navigation-related features

SunnyDaysApp may provide route calculations, Pathfinder routes, route previews, distance information, elevation information, map previews and navigation-related features.

Routes may be inaccurate, blocked, dangerous, private, seasonal, closed, unsuitable, unavailable or different from real-world conditions. A calculated route does not mean that the route is safe, legal, open, maintained or appropriate for your situation.

You are responsible for checking whether a route is suitable before and during your trip.

8. Ski, mountain and winter information

SunnyDaysApp may show ski resorts, mountain places, winter destinations or related map/weather information. The app does not replace official ski resort information, avalanche warnings, lift status, piste status, mountain rescue information, weather warnings or local rules.

Before skiing, hiking in winter, entering mountain terrain or doing any risky outdoor activity, you must check official and current local information separately.

9. Lakes and water-related information

SunnyDaysApp may show lakes, water areas or related outdoor destinations. Lake information does not guarantee swimming safety, water quality, legal access, parking access, lifeguard presence, ice safety, current water temperature or current local conditions.

You are responsible for checking signs, rules, water safety, weather, access rights and local conditions before entering or approaching water.

10. Accounts and login

SunnyDaysApp plans to support accounts at launch using Google login and Apple login. You are responsible for keeping your account access secure and for any activity that happens through your account.

You must provide accurate account information where required and must not use another person’s account without permission.

We may suspend, restrict or delete accounts if we reasonably believe that the account is used for abuse, scraping, API attacks, bypassing ads or payments, violating laws, violating these Terms, harming SunnyDaysApp infrastructure or harming other users.

11. No user uploads at launch

SunnyDaysApp is not planned to allow public user uploads, reviews, comments, photos or shared user-generated content at launch.

If upload or sharing features are added later, these Terms may be updated with additional rules for user content.

12. Ads

SunnyDaysApp may be supported by advertising at launch. Ads may be shown through Google AdMob or related advertising services.

Ads may be personalized or non-personalized depending on your consent, location, device settings, applicable law and available ad-provider options. More information is provided in the Privacy Policy.

13. Subscriptions and paid features

SunnyDaysApp plans to offer SunnyDays Pro through Apple App Store and Google Play. Pro has two benefits: ad-free use and downloadable offline maps with local PathExplorer route generation and navigation without internet, including in airplane mode when the required data was downloaded first.

If paid features are introduced, payment and cancellation may be handled through Apple App Store, Google Play or another payment provider. Additional subscription terms may apply.

14. App stores, payments and refunds

If you download SunnyDaysApp through Apple App Store or Google Play, your download, purchases, subscriptions, refunds and store account may also be governed by the relevant app-store terms.

If paid features are introduced later, refunds for app-store purchases will usually need to be requested through Apple App Store or Google Play, depending on where the purchase was made.

15. Third-party services and data sources

SunnyDaysApp uses third-party services and data sources to operate the app and website. These may include app stores, login providers, advertising services, hosting providers, map data, weather data, terrain data, satellite/open data, email providers and infrastructure providers.

  • Google login and Apple login for accounts.
  • Google AdMob for advertising.
  • Hetzner Cloud for backend hosting.
  • Cloudflare R2 and Cloudflare infrastructure for tile storage and delivery.
  • Meteoblue, GRIB weather files and other weather data sources.
  • OpenStreetMap vector data.
  • AWS Terrarium terrain/elevation tiles.
  • Google Workspace for email support and communication.

Third-party services and data sources may change over time. Attribution and license details are listed or will be listed on the Attributions page.

16. Prohibited use

You must not misuse SunnyDaysApp, its website, API, data, maps, route engine, accounts, advertisements or infrastructure.

  • Do not attack, overload, disrupt or damage the app, website, API or backend.
  • Do not bypass, remove, manipulate or interfere with ads, payments, account systems or access controls.
  • Do not scrape, bulk download, mirror, harvest, resell or redistribute SunnyDaysApp tiles, data, routes or API responses.
  • Do not reverse engineer, decompile or attempt to extract source code except where mandatory law allows it.
  • Do not use automated systems to access the service in a way that creates unusual load or harms the service.
  • Do not use SunnyDaysApp to violate laws, access restrictions, property rights or third-party rights.
  • Do not copy the app, brand, design, compiled tile system or backend functionality to build a competing product without permission.

17. Commercial use

Normal personal use is allowed. Normal professional planning use, such as a person checking a route or destination for their own workday or outdoor plan, is also allowed.

Commercial reuse of SunnyDaysApp data, bulk downloading, scraping, copying, resale, redistribution, API extraction, tile extraction or building another product from SunnyDaysApp data requires prior written permission.

18. Intellectual property

SunnyDaysApp, the SunnyDaysApp name, website design, app design, app code, backend code, Pathfinder logic, compiled tile systems, visual design and related product elements are owned by the operator or licensed to the operator.

Some underlying data is based on third-party or open-source sources. Those sources remain subject to their own licenses and attribution requirements.

19. Availability and changes

SunnyDaysApp is an evolving product. Features, countries, maps, tiles, routes, providers, weather layers, ads, account features, pricing, subscriptions and availability may change over time.

We may add, remove, limit, update, suspend or discontinue features where needed for technical, legal, business, security, licensing or product reasons.

The app may also be unavailable because of maintenance, hosting issues, provider outages, app-store issues, data-source changes, network problems or other causes.

20. Account deletion and data deletion

You may request account deletion or data deletion by contacting SunnyDaysApp. In-app deletion tools may be added later.

Some records may need to be kept for legal, tax, billing, security, fraud-prevention, backup or dispute-resolution reasons.

21. Children and young users

SunnyDaysApp is not specifically targeted at children. It is a general outdoor planning app intended for users who are allowed to use digital services under their local law.

Children and young users should use SunnyDaysApp only with permission and supervision from a parent or legal guardian where required by law.

22. Privacy

The Privacy Policy explains how SunnyDaysApp handles personal data, including location data, route requests, accounts, advertising, support communication and future subscription data.

23. Limitation of liability

SunnyDaysApp is provided as a planning and information tool. To the maximum extent permitted by applicable law, SunnyDaysApp is provided without guarantees that it will always be accurate, complete, safe, uninterrupted, error-free or available.

To the maximum extent permitted by applicable law, the operator is not liable for losses, injuries, damages, missed trips, wrong routes, weather changes, inaccessible destinations, unsafe outdoor conditions, data inaccuracies, service interruptions or third-party service failures caused by use of or reliance on SunnyDaysApp.

Nothing in these Terms limits rights that cannot be limited under mandatory consumer protection law.

24. Applicable law and local rules

These Terms are governed by Austrian law where legally permitted, without limiting mandatory consumer protection rights that may apply in your country of residence.

When using SunnyDaysApp outdoors, you are responsible for following the laws, access rules, safety rules, traffic rules, trail rules, ski-area rules, water rules and local regulations of the country and place where you are located.

25. Changes to these Terms

SunnyDaysApp may update these Terms when the app, website, accounts, ads, paid features, subscriptions, providers, countries, data sources or legal requirements change.

The latest version will be published on this page with an updated “Last updated” date. Continued use of SunnyDaysApp after an update means you accept the updated Terms, unless applicable law requires a different process.
